Measure Z Developers Daichendt Caught Telling Lies to Voters…Yet Again

The developers behind Measure Z—the controversial ballot initiative seeking to rezone a portion of the Rancho Santa Margarita Auto Center, have been caught telling another bold-faced lie to voters.

Theory R Properties just delivered the attached political flyer, TheoryR Measure Z Flyer, to voters all across Rancho Santa Margarita, making the false claim that:

“The city council majority is doing everything possible to defeat Measure Z – including filing a frivolous lawsuit with your tax dollars.”

Problem is—The City has NEVER filed such a lawsuit.

The City of RSM issued this Press Release, City of RSM Release 092514, to confirm that this latest outrageous claim by Theory R Properties was simply another false statement by dishonest developers who seem willing to say and do virtually anything in order to enrich themselves—regardless of the damage they cause to the residents and City of Rancho Santa Margarita.

The corrupt actions and lies told by these developers are really beginning to pile up:

  1. Judge Ruled Daichendt Made Six Illegal False Statements in His Measure Z Ballot Argument. Daichendt was also recently exposed for numerous false public statements related to his Measure Z ballot initiative. OC Superior Court Judge Kirk Nakamura ruled Mr. Daichendt had made six (6) illegal statements in his official Ballot Argument in Favor of Measure Z. The judge ordered the Registrar of Voters to remove those false statements before they were printed and distributed to voters with their sample ballots so RSM voters would not be deceived by Mr. Daichendt.
  2. Daichendt Telling Voters No Auto Dealer Interested in Occupying this Property – but Daichendt is Holding an $8.5 Million Offer from Toyota. Joe Daichendt continues to state that no auto dealer is interested in occupying the former Nissan dealership site and he suggests the City of RSM was simply waiting for “Tesla or some other dealer will drop in from heaven” – but he failed to mention he has received multiple offers and that on August 28th, RSM Toyota submitted to him an $8.5 million dollar offer to purchase the property. RSM Toyota Offer
  3. Developers Sued the City of RSM for $10 Million Dollars. 
  4. O.C. Sheriff’s Department Confirms Daichendt was Not Evicted from State of the City Presentation by Chief of Police. The OC Sheriff’s Department and the City of Rancho Santa Margarita issued a Public Statement confirming numerous public allegations made by developer Joseph Daichendt against City of RSM personnel were completely false and without merit. Joseph Daichendt had falsely claimed “This morning I was thrown out of the “State of the City” speech by Mayor Carol Gamble.   5. Theory R Properties is Financing a Slate of Three Bought and Paid For City Council Candidates. This political flyer TheoryR Measure Z Flyer and financial disclosure records confirm Theory R Properties is also trying to take over control of the RSM City Council in the November General Election by financing the campaign of the “Yes on Z +3” slate of three council candidates (Jesse Petrilla, Donald Chadd and Laurie Biehl).

The former Nissan auto dealership in RSM is owned by Rancho Canyon LLC—an entity owned by real estate development company Theory R Properties. Gary Daichendt is the founder and Chairman of Theory R Properties—and he is the former Executive Vice President of Worldwide Operations for Cisco Systems Inc. (where he was the #2 executive of what was once the world’s highest market cap company). Gary Daichendt is a multi-millionaire who lives on exclusive Riviera Drive in Irvine Cove (Laguna Beach) in a mansion valued online in excess of $20 Million Dollars. His young son Joseph Daichendt works for his father’s company and his family lives in Ladera Ranch.

The campaign waged by Theory R Properties and the Daichendts in support of their Measure Z ballot initiative will long be remembered as one of the most unethical, dishonest and nasty campaigns in the history of Orange County politics.

Measure Z is opposed by every Mayor in the City of Rancho Santa Margarita’s history – and by a majority of the current RSM City Council and Planning Commission. All RSM Residents are being urged to VOTE NO on Z!
